Eversheds Debt Collectors demanding £7900 by 2nd April.HELP!!!!

Hi,

I hope you can give me some advice. I have a loan with Northern Rock, but I've been unable to make the full payments since November as I have been in and out of work. I have been able to make small payments to them, perhaps £30/£50 a time. However, I have not made a payment for March. I last made a payment in February and they were supposed to be sending me a form where I could write down all my expenditure so that I could make reduced monthly payments until I was more financially stable.(I haven't received this) However, last week I received a letter from a Debt Collection Agency telling me that they they want full payment of £7900 by 2nd April. What should I do? I was under the impression that NR were aware of my current situation! I've been unable to sleep since I got this letter as it's threatening that people will come to my home and take things!! (It's not even my home, it's my parents. Surely they can't do that?!)

I would like to set up a DMP , I have other debts (some I have arranged lower payments with),but I just wanted to know where I stand on this matter before continuing.

Really hope you can give me some adivce.

Oh, forgot to add that I'm claiming Job Seeker's Allowance which is £60.50 a week. That's my only income at the moment. And before i get berated for not having a job. It's not through lack of trying!! (Sorry, I know some people can be quite funny about this!)

  • I have a loan with Northern Rock, but on Friday I got a letter to say that my debt had been passed on to some company called Eversheds. In it they're demanding I pay £7900 by 2nd April!! The letter has absolutely scared the bejesus outta me. I'm sick with worry that someone is going to come round to my parent's house (I lost my job in November and moved back in with them in Jan) and take their belongings!!

    The debt collection agency rang this morning but it was one of those automated lines "if you are miss w press 1" which I did, but then the line went dead. I did 1471 and rang the number back, but I got a dead line. They also rang about 20 mins ago, but this time it was a dead line when I answered rather than an automated one. I don't trust them, but like I said before their letter has really frightened me. Obviously the 2nd of April is V V soon and I just don't know what to do.

    I thought NR were aware of my financial situation as the last few months they've accepted payment of £30/£50 a time instead of the usual monthly payment of £193. I've had no letters or calls from them to say that my debt was being passed on etc.

    [FONT=&quot]I've been trying so hard to get a job but it's proving to be so difficult when there's 250 people applying for one job!! The only income I'm getting at the moment is Job Seeker's Allowance and I'm due a payment of it tomorrow. Would it be best to ring up NR tomorrow and offer a small payment?

    Don't panic, it's highly highly unlikely anyone will call at your parents home, and even if they did they have no right of entry and can not take anything that doesn't belong to you personally.

    Eversheads will be Debt Collection Company and all that will happen now is that instead of paying northern rock you will pay them. The phone calls will be them trying to contact you to find out how much you can afford to pay. Usually once a debt gets passed on like this it's easier on you because as long as you pay what you have agreed with them they usually don't bother you with calls or letters hassling you for more money.

    Is the loan to northern rock the only debt you have?

    If not I strongly advise you to call one of the debt management charities. I'm on a debt management plan with cccs, and they have been a great help.

    This is probably a termination letter. This is a normal part of the legal process. They do not expect you to pay up, just they have to give you the chance beofre they list a default on your credit record.

  • Do they still add interest to the amount owed? If so, is there a way of getting the interest frozen?

    had been passed on to some company called Eversheds.
    Eversheds are the external solicitors for NR.

    Chance are this will result in a court claim being issued, DON'T PANIC.

    There is a procedure NR must go through prior to issuing a litigation claim.

    Have you received a default notice & termination letter/

    If so, can you post them up or PM them I need to see if they've been issued correctly, remember to remove personal details.

    You can try talking with one of the Debt Counselling Charities, such as: Any of the above charities will be able to advise on how best to deal with this debt, and how to contact the creditor/dca in regards to negociating things like 'reduced payments' and the 'freezing of interest'.

    Also worth looking at the following link, showing how eversheds should behave when dealing with you, especially in relation to any 'home visit':
