Rejected appeal?

Hi,

I parked my car in a busy car park which is where everyone parks for numerous stores including comet, toysrus, dixsons etc. It is "controlled" by Excel parking.

I bought a ticket, displayed it, went into Dixons bought an iron and got back in my car to find I had a ticket. I was in and out within 40 minutes. The ticket had feel on the seat. I photocopied the ticket (which was valid for the time I had a ticket) sent it off expecting it to be quashed as it was just a genuine error. However they have sent me back a generic letter saying thats not allowed and I must pay by Friday or I will owe £100.

Surely this can't be allowed as the ticket was bought? Can I appeal? Can anyone help it would be greatly appreciated.

    The best advice is don't contact them & don't pay. Don't say who was driving and ignore the rubbish they'll send you by post.

    In case you're wondering how they'll get postal details of the registered keeper of the vehicle - they contact that sleazy government department, DVLA, who happily dish out personal details in exchange for cash (£15 million last year).

    I note they mention you owing them £100 - but if they do take you to court (highly unlikely) they'll need to prove that they lost £100 as a result of you parking there. They can't just make up a figure and take you to court, it has to be a proven loss.

    As things stand, that figure is £0.00, so don't waste your time on these scammers. They make their money from people who pay up after feeling intimidated by the empty threats of court action, bailiffs, etc.

    OP, they are a business. The whole point is for them to make money. Why would they ever tell you not to bother paying?

    Crabman's advice is good. Excel have had a pasting in court anyway, and are unlikely to issue proceedings. However, do be ready for the barrage of ever-more threatening letters. But you can safely ignore them.

    There is no appeals process. It's a private company - they're not going to turn away profit.

    • do not pay
    • do not contact them again
    • ignore their threatening letters and hollow threats
    • they will give up and go away
    • they will not take you to court
    • it's nothing more than a mail scam. They want you to contact them so thay can size you up. As you contacted them, they may well pester you for longer, but they will give up eventually.
    • we know Excel very well. Muppets.
