EA found me a tenant on a 6 month fixed contract and i paid them a fee upfront. tenant stayed in property for another 12 months on a periodic contract. EA did not contact me until they found out tenant was moving out and now want to invoice me for 12 months commission. is this allowed? In EA agreement it does state fee is payable at the commencement of the tenancy for the full term. however, after the 6 months the EA did nothing and the tenants went onto a periodic contract - even though it states in the EA terms that just before fixed contract has expired they will offer tenant the option to extend etc.

I would say as the agent did not offer the option to extent, no fee is payable. As you say, the tenant went onto a periodic contract.0
