Ex employer paid my wages - DO I GIVE IT BACK

my ex employer who made me redundant 2 days before christmas last year, gave me the equivalent of a months wage in february. Originally they emailed me to say sorry and that their bank would be taking it back automatically. However their bank RBS have now written to me saying i need to send them a cheque.

I ask the question because I used to work for A&L 8 years ago and when that happened to a customer they repaid them a minimal amount each month.

I dont want them to have the money because a) they got rid of me, b) im left paying £450 a month for a car that is nt even mine which they used to py as my expenses c) im still waiting for them to pay my last mobile expenses and send me another copy of my redundancy letter.

Any legal advise would help

    Deduct the mobile expenses and return the rest.
    How come you are paying £450 for a car you don't own?

    they didnt provide a company car so i was rushed into a quick option by them. so i opted for a long term rental. I pay £450 per month and am desperate to finish that but i cant

    (Note: This is not legal advice)

    In that case I'd say do the following: Tell them you can't send a cheque as you spent the money, thinking it was legitimately yours (why else would they have paid it?). However, you now recognise that they made an error and so you can offer to pay it back at £(very small) per month.

    Hi,
    There is the little known law of estople(think that's how you spell it). Basically if they paid you, you didn't ask for it! You have spent the money as you thought you were entitled to it, and you would be financially inconvenenced if you had to pay it back then under this law you shouldn't have to pay it back. This happened to me about 6 years ago. my ex-employer wrote to me saying they wanted the money back. A friend who worked for citizen's advice told me about estople and I just ignored the letter they sent me. I never paid it back and they never pursued it!

    Estoppal is the word you want

    Doesn't apply here as OP has no reason to think he's entitled to the money
