Do I Need H.I.P.S

We are trying to sell our house private, so i put an ad in the local paper and an home made sign up outside with my tel number on, a builder is interested in our property because of the stuff he can do to it and the land with it, as of yet we have not got a H.I.P but were going to phone about tomorrow and get one sorted. But ive just looked on the the direct-gov website andhave found this
You don’t need a HIP for:
  • properties where there is no marketing, for example if you are selling to a member of your family
  • non-residential properties
  • properties limited by law to use as holiday accommodation or occupation for less than 11 months per year
  • mixed sales, for example a shop with flat
  • sales of portfolios of properties, for example selling two properties together
  • properties not being sold with completely vacant possession, for example with a sitting tenant
  • unsafe properties and properties due to be demolished
  • properties sold through the ‘Right to Buy’, ‘Right to Acquire’ and ‘HomeBuy’ home ownership schemes
Do you think i will need to spend money on one as he will be having the surveys done himself etc. I know it gives selling to family as an example but would selling to someone (also cash buyer) whose not family be the same. We are not losing money on the property but at the same time the few hundred quid we will save can help pay for other things. Thanx in advance

    Yes you do, by advertising in your local paper you are still "advertising your home for sale" so you do need a H.I.P

    Look around, you can get some great deals online, i got stitched up with a H.I.P from your move, when they first came out, £450.00 plus vat, seen me coming .....lol.

    So just out of interest on 6th April 2009 the H.I.P.S must be available on the first day the property is marketed, do i then have the right to say my house was being marketed already, in which case people thinking about selling there house should put adverts in there free local rags to avoid getting one till they know they have a sale, only isnt there a 12 month life limit to certain parts of the pack. Hope im not appearing thick but obviousley £200-£450 is better sitting in my bank account than somebody elses

    To market a house now, today, you have to have ordered the HIP. From the 6th April 2009 to market a house you have to already have the HIP. You can't wait in either case until you have a sale!

    By putting a house in the paper you have marketed it so have already broken the rules by marketing a property without having ordered a HIP. The fine is £200 per instance of marketing so if the advert appears five times then the fine is £1,000. Fines are the responsibility of trading standards but apparently aren't a high priority.

    When we put our house up for sale we had a "grace period" so long to get a H.I.P after it was first marketed, we still had to get one as it was in our t&c.

    The fact you have to get it for your first day of marketing doesnt really make much difference to the old regs, just puts the onus on you to sort it so you dont get ripped off by an estate agent,.

    Gee thanx for the advice i didnt realise that, will be ordering one tomorrow, but should not the papers where the adverts are placed ask if there is an H.I.P in place already, otherwise they could also be accountable for breaking the rules ????

    No. The seller is reasonable or the agent if you are using one.
