Setanta Sports & Distance selling!

..you may recall a couple of months back the problems I've had with Setanta Sports in regards of the Distance Selling 2000 act! Basically they sold me over the phone 6 months at £10.99 but on reflection I felt that I was wrong to do this as 3 months of those 6 had no football on at all as it would be the summer & the football season was over. So I decided to phone them back and ask if they'd revert back to my old £12.99 a month deal so I can cancel when the season was over however setanta didn't want to play ball! When I asked them that I had rights under the distance selling ast 2000 which states a 7 day cooling off period they claimed that the distance selling law doesn't apply to them as they're based in Luxembourg & therefore go under Luxembourg law :confused:strange considering that I live in Gateshead & the call centre I contacted was in Sunderland?? So how can Setanta who operate in the UK go by Luxembourg law to get out of distance selling:confused:

Anyway I contacted my local trading standards based at Gateshead Council & they couldn't be more helpful I explained my situation & they agreed with me that I had a very strong case against them!:j They sent me a draft letter to complete & send off to Setanta (recorded delivery) I then did it ensured my letter was signed for & waited to see what would happen. Gateshead Council contacted me every few days to let me know how they were getting on & basically to put it bluntly they found them extremely evasive & difficult to deal with (surprise suprise):rolleyes:

Anyway this week the council phoned me again to say they've finally sorted it however not without difficulty! They said that they've decided to cancel my contract with immediate effect but they still said that distance selling still didn't apply to them ( their arrogance knows no bounds):mad: If they were so in the right then why didn't they fight it in a court of law??:rolleyes:

Anyway success for the little people & a victory for good over evil! Don't let Setanta bully you & remember you have rights!!:T
