Discharged but threatened with summons

Hello everyone,
I was discharged in Dec 2008. After exactly one year not early. In June 2007 I was accused of bumping another car outside a shop. The bloke who did the accusing was quite aggressive and so I gave him my insurance details to keep him quiet and denied the accusation when my insurance company contacted me a few weeks later. No witnesses to any offence just him claiming his car had been damaged and I must've done it because no one else was in the area.
Anyway my car was inspected by an assessor for damage, of which there was none, and I haven't heard anything for the past 18 months. In this period I've gone BR and been discharged.
Now I've just received a letter from my insurance company warning me that the "other party" are looking to issue a summons against me as my insurance has refused to pay up. So my question is as follows. I didn't do anything wrong but if the "other party" has managed to conjure up a witness and I will be unfairly forced to cough up will this be covered by my BR as it took place in June 2007?
thanks

I don't think it is covered by your BR as it only covers bills etc that you included in it at the time of going BR...no doubt someone with more knowledge than me will be along shortlyGE 36 *MFD may 2043

It should be nothing to do with you - That's what you have insurance for! Inform your insurers of the situation and let them deal with it.“I contend that we are both atheists. I just believe in one fewer god than you do. When you understand why you dismiss all the other possible gods, you will understand why I dismiss yours.”

Not sure how it would be affected with the bankruptcy but if you want "legal" advice on the situation then it might be worth posting on the pepipoo forum (http://www.pepipoo.com/) .. they are very knowledgeable on these things!:hello:Save a little money each month and at the end of the year you’ll be surprised at how little you have.An eye for an eye only ends up making the whole world blind0

Do you have legal cover with your car insurance?
I had a similar thing happen to me, knocked over a parked bike (no rider on it at the time). Admitted everything to insurance company but around 2 years later I received a Summons as my insurance company wouldn't play ball with the other insurance company. Eventually they sorted it out, I got some good advice from the "Insurance" board, might be worth posting in there?BSC No. 2540 -

I thought even bills forgotten at the time of BR were included. That is the point of the announcement in the local paper. Or not?

When I went BR I was under the impression that everything you wanted in the BR should be documented at the timeGE 36 *MFD may 2043

I know for "normal" debts that even if you don't put them on your forms they're included but not sure about civil claims via the court (for "damages")

Thanks. I was beginning to wonder if I should admit to the offence and let the insurance pay up. But I reckon they would try to get me for not admitting it from the start and misleading them. Fraud charge. So I will wait for the court papers to arrive and deny everything because that's what happened. Nothing. My insurance company would have no qualms about stitching up an ex-customer like me.
