LL Wants Fixed Contract, I Want Periodic

As above really. Contract ends on 8th May, he wants us to sign another 6 or 12 month contract (at a guess with transaction costs falling to us, something I would be negotiating away anyway). I want periodic as we are looking to buy a house anyway, plus we dont particularly like the house we are in, as there are several niggly problems the LL hasnt sorted out yet. The location is also poor and I want a driveway/garage to store my new motorbike in, which cannot be provided for here.

Basically what rights do I have to say 'stuff your contract up your !!!!, Im staying periodic'. If im right, LL has to give us minimum 2 months for an eviction notice? We have to give him 1 month?

I am a good tenant, keeping his house in a decent state of repair and cleanliness, pay bills on time, dont pester him night and day etc, so basically i would be calling his bluff, with no particular risk to me?

    Dear dannymccann.. Your interpretation of the law is correct.

    However you can't trust my reply further than you can throw me (I'm a Landlord!).

    Only other risk I can see is that of references from him in future.

    AFAIK you don't even have to reply to his written or verbal requests to sign a new deal. It would seem sensible & polite to tell him, gently & politely tho, as "stuff your contract up your !!!! " may not get the best Tenant<=>Landlord relationship in future..

    Polite delay tactics. Respond by sending the contract back unsigned and say you do not wish to renew contract but intend staying on a periodic basis. Leave him respond.

    Check that you weren't sent a section 21 (notice to quit) soon after the initial fixed period started.

    As Silvercar says, check that you weren't issued a S21 earlier in your tenancy. The particular risk to you is that the LL/LA may prefer the relative security of a new tenant prepared to sign up to a new Fixed Term and may just give you that 2 months Notice earlier than you anticipated. (If you paid a tenancy deposit after 6 Apr 2007 then it should have been scheme-registered - if it han't been then no valid S21 may be served, until such time as it is does get registered.) If you have the Lls name & contact address, why not contact him/her direct? If you ask your LA in writing for the LL's info they have to give it to you within 21 days of receiviing that request.
