Bank gave out details to someonelse

    She should get compensation because the bank have breached the data protection act and from the banks point of view that's probably a better option than the alternative.

    ... OR, as has not yet been established the bank is in SA which may not have the equivalent of a DP Act. If it is in breach then I would say the person was entitled to some compensation .. maybe £20-£50 but to expect your overdraft, loans etc. to be paid off is just laughable (as are expressions involving the words human rights etc. and emotional damage). In the bigger picture, from the OP it appears that, if anything, the bank may have done this person a favour.

    I mean upto £100 compensation is acceptable but anymore and I think I might send my Mum in to try it!

    I would suggest the Office of the Information Commissioner may be a good call as well - they could advise you on the frequencies of such events and what sort of compensation you may be likely to collect.

  • I know this is different circumstances but as a guide.....and without giving too many details!

    Someone I know used to bank with X bank. They split up with hubby but there bank a/c was in there name only. Hubby was abusive so she moved away - in hiding. Anyway hubby found her, moved again, found again. Turned out he know someone that worked at X bank and they were looking her details up and giving him the new address. Cut along story short - bank paid her 5k compensation.

    Mancitychick, it is different because the person involved would have had ACTUAL losses due to having had to move on several occasions. Unfortunately there is never any way to legislate against dishonest staff ... it is a pity that the bank paid this compensation .. it should have been the staff member (they were the only one responsible).

    A slightly different story, my bank statement was posted in the same envelope as a mortgage statement for someone who lived four doors away from me. :eek: I was overdrawn so i was really upset about this and very angry :mad: in the end the halifax gave me £100 for my upset but said that they hadnt breeched the data protection act because the mailing machine had made the error :rolleyes:

    This sort of thing can happen .. and note that it is often one of your neighbours that gets your documents ... why? It is because of the address sorting used by the software to maximise discount .. one of the main criteria is what is known as a 'walksort' (i.e. the letters are printed in the same order as the postman is expected to deliver them therefore the post office has no work to do). The stuff is printed off in the same order and sometimes the electronics of the print machine does not separate it correctly.

    The only solution is going back to checking everything manually ... but that is in nobodies best interests.
