They dont operate any advisers or sales reps so how did they mis-sell it?
You buy from them. They dont sell it.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -

got it via a broker
So the liability is with the broker. Not Assurant.solicitor and ombudsman have said got a very good caseI am an Independent Financial Adviser (IFA). but solicitor aswell
The rules on advice cases are quite clear. If is the adviser that carried the liability for the recommendation of the product. Not the provider. The provider only carries liaibility in the servicing of that product (i.e. in the event of a claim you dont agree with their response). If your complaint is that the product is unsuitable then its not the liaiblity of the provider as they didnt tell you it was. It was the adviser that did.
As you say it was mis-sold, then the complaint should be against the "seller".I am an Independent Financial Adviser (IFA). Having put a complaint in against a solicitor two weeks ago who gave a mutual client bad advice I wouldnt assume they are right. (in my case, the solicitor got the product type wrong, made all sorts of incorrect assumptions and was then foolish enough to put it in writing and as a result the client now has to face costs which they wouldnt of done. The solicitor clearly didnt know much about financial services). Does your solicitor know the FSA rules and who carries liability as it appears he doesnt from what he has told you.

Hi Dunstoh
Thank you for explaining that to us all. We have had same advise on here often so it is good to remind ourselves. Also your comments about the Solicitor are worth us keeping in mind. Thank you;):mad:0
