Do I make a 'no win no fee claim'

Hi gang, Alex here.

On the way to work this morning I was sitting in my car 15' behind the van in front sat still at traffic lights.
I saw a van come over the brow of the hill behind me and brake, but as it was icy he just walloped me and moved my car 1 - 2' forwards breaking my rear bumper.
Since about lunchtime my neck has started to hurt like a !!!!!!!
Now I am really really against the compensation culture but should I make a claim? If so how much do they pay out for 'whiplash'.

  • yes i would and i have 3 times..i got 1750 , 2250 (had physio and needed it) and my latest one is with a holiday company were we were in an accident on holiday in a coach which was actually pretty nasty..they have just accepted fault after trying to say it was not there fault due to the fact we were abroad (even though it was part of the package on a coach they provided with no seatbelts and a very clueless rep) Anyways I reakon at least 2k on this one as it ruined our holiday due to a lot of animals being killed in the accident and we picked up injurys...i must be unlucky

    Perhaps it might be a good idea to make sure you're OK first? I'd see a doctor/A&E before an ambulance chaser.

  • I agree first with rdwarr.

    Get medical opinion first. You can report it to your own IC who will instruct a Sol if you are fully comp. Some include legal cover as part of the package. But beware, this will consitute a claim, possibly affecting NC Bonus, if full recovery is not made.In case you only have TP etc you should still inform you IC in case of reverse claims( they do happen), but tell them you are taking the matter on yourself.

    Beware of NO WIN NO Fee. It means what it says, and there can be,usually is, a fee if you win. There are firms that actually charge you nothing, win or lose, but it is a little intricate to spell out the manner. Listen to Classic Radio for BGR Bloomer ads, I cannot remember the Freephone number.

    Last of all, make sure you have the correct details of the other driver. If they are wrong and he cannot be traced, or you find he is uninsured then contact the Motor Insurers Bureau through your Sols.

    I don't know about other companies but Churchill legal cover is a separate policy so does not constitute a claim against your no claims if you use it.

    No win, no fee can be a minefield but if you use a solicitor, not a claims farmer, you should have no problems. I have just checked, double checked and checked again a NWNF contract for someone who will not pay anything for the service when she claims.

    No Win No Fee - has the benefit of no risk being involved for claiming but when you do win, the fees would be higher than a normal solicitor.

    If the liklihood of a successful claim is high go with a normal solicitor as it may be more financial rewarding in the long run

    When you win, the fees are claimed from the other party. You need to make sure there is no success fee payable and that there is no provision for any costs claimed but not met by the other party to be met by you. When I went through the one I mention above, there was no layout for the claimant except an insurance policy which the solicitor is funding up front and which is recoverable against the insurers of the driver of the vehicle responsible for the accident. Liability is not in dispute.
