Redundancy letter received - help?

Have received a redundancy letter today, dated one month ago, stating that employment terminates next week, and quoting dates in the past few weeks for handing back keys etc...............
How does that stand up legally ?
Would appreciate any assistance !

A two minute passing conversation at most 4 weeks ago, as leaving office, stating that if things did not pick up, everyone was at risk. Was also stated it would be confirmed in writing.
Well I guess that is the letter today, dated 4 weeks ago, quoting dates in the past for expense claims, and key and phone returns. I am entitled to 5 weeks with service as notice period which is next week. But am also Director of company, (no shareholding).
I think that adds abit more !0 -
Is your company very small? Is the company closing or just some staff being let go?
What you describe bears no relation to any redundancy process I have ever run or advised on and does not come within a country mile of fulfilling process/legal obligations.
In summary. You should have had a proper consultation. You should have been notified of this in writing in advance, and proper meetings should have been held over a reasonable period of time. At the last of these meetings you should have been notified in writing of your redundancy as well as being given details of the payments related to this + your right to appeal. Your future termination date should have been notified to you in advance via this letter and you should also have been told whether you were going to need to work your notice or if this was being paid in leiu (this cannot be backdated!) In addition the company is likely to owe you stautory redundancy pay (basically 1 weeks salary per year of service capped at £350 per week)
Sending someone a shoddy backdated letter is totally unacceptable even for a small firm. You seem to have a strong case for unfair dismissal and need to seek advice from a lawyer asap.Go round the green binbags. I get the impression that this letter today is the letter that should have given out 4 weeks ago.
It states " having considered all the circumstances, i confirm that your job is to be made redundant".........."requires you to take, during the notice period, the remaining annual holiday entitlement....up to the date of termination".
"The notice payment is subject to tax etc, your P45 will follow in due course"
It does also state Stat Redundancy Payment
However, an added twist is because of financial difficulty, the co has applied for CVA, and staff have not been paid for Feb or as yet Mar.......0 -
And sorry yes it is small. I no longer know whether it will close or just letting some go.............if it closes then i guess CVA will disappear and Liquidation will ensue0
