Quidco/Small Claims Court?

Folks,

In March 2008, I took out home/content insurance with Churchill via Quidco, which offered £80 cash-back.

This figure is still to be validated, never mind forwarded to Quidco or paid out to me!

Would I be able to take this matter to a small claims court and if I did, would it be Quidco or Churchill I'd have to make the claim against?

I know this might sound a little drastic, but £80 is £80.

Any constructive advice would be greatly apprecaited.

Sorry, should have put this in the OP. I raised a ticket regarding this issue in October 2008 and been told that Quidco are working with the merchant to resolve this matter and hope to have it resolved "as quickly as possible".

I've followed up this ticket each month, asking for a further update and basically had the same type of response. Quidco have acknowledge I am due the £80, but seemingly Churchill aren't playing ball. :mad:

You will have a problem pursuing Quidco as they operate on a pay when paid approach. If they haven't been paid, you cannot pursue them.

Cashback through these schemes is never guaranteed, so I doubt whether you have any claim at all against anyone.

For the time and hassle it'd take to take this to court it really isn't worth it.

It's £80. And keeping things in perspective, that £80 wasn't ever really yours to begin with. It's effectively a discount, or a bonus for going through Quidco - and it isn't guaranteed. I would never use Quidco just to get cashback, if it's available on something I would buy anyway then it's a bonus but I never expect it.

I've had to wait for over a year for some cashback after chasing it up with tickets etc. I think you just have to accept that the system isn't perfect and that any cashback you get is a bonus, I don't think it's anything we're entitled to.

I make no comment on your chances of winning but it is Quidco you would need to take action against their registered office is Maple Syrup Media Ltd. 36a Gordon Rd. Dartford. Kent DA12LQ.

I do seem to remember some discussion earlier last year on the Quidco thread and papers were served for exactly the same problem with Quidco/Churchill but it didn't get to court as the money was finally paid

Not sure it would be Quidco. All Quidco do is provide a mechanism of collection so in that respect I think they probably act as the agent of its account holders.

Unless the OP can show that Quidco have actually received the money, I can't see how it can proceed.

When you join Quidco you accept their membership ts + cs, which say:

Any offer of cashback for a transaction is made by Quidco and not by its merchants

Merchants are listed on the Quidco site as giving either a percentage or fixed amount of cashback, for each genuine, completed transaction. Under no circumstances does this form a guarantee that you will receive any monetary amount as a result of your transaction.

So you would waste your time and money suing them for the money.

I once managed to get money back from a supplier who was suspended (well,I had nothing to lose,I was going with that company whatever),so you never know,keep onto Quidco.

I also had a problem with churchill and quidco. took out my home insurance in feb08 and it has only just verified this month! march 09!

Has it been validated?

I just kept emailing them every day chasing it up

Quidco have acknowledge I am due the £80

What does that mean?
