OK so a few mths ago i had to make an agreement with RBS about my mortage, I agreed to pay an extra £74 pound a mth for 6 mths to clear an arreers. Not a problem you'd think. Well since then the basic amount i pay has dropped but i've still been paying the same amount for the last 4 mth.
So in effect i've cleared my arrears quicker. Again not a problem you'd think.
Well last week i phoned them to confirm what my March payment would be and was told a figure almost £150 less than i was paying....whoooo hooo i think.
WRONG.....today i check my bank to find they had taken the Higher figure again!
Phoned them to ask for the diffrence to be refunded and told i would have to wait 4 days.... till they had the money.(I don't have it, it's gone from my account)
Quoted the Direct Debit Garantee to them only to be told that they had no way of refunding the over payment till they had the funds!
SO MUCH FOR THIS : you are entitled to an immediate refund of the amount debited from your bank under the Direct debit garantee
taken from : the bacs web site.
Seems the RBS has found another way of not paying what they owe!
Do i have any recourse against them??

Sounds like an admin error on their part.
Just like getting into arrears was an error on your part.
Don't see why you should have instant recourse for their mistake when they allowed you 6 months to resolve your problem!
Until the funds reach their account, they have no guarantee that your direct debit won't bounce (again). So I don't see why they should refund you. If you banked with RBS/Natwest it would probably be different, but with our antiquated banking system it still takes 3 working days to process payments between banks - even direct debits.
