Advice needed re LLoyds TSB

I hope someone can help me with this interesting scenario.

I took out home contents and buildings insurance with The Post Office in April 2008 and paid by debit card. Anyway my policy is due for renewal soon and I received a renewal quote from the Post Office advising me of this and it states that if they don’t hear from me they will renew my insurance policy automatically. I then looked at my payment details on the renewal quote and was horrified to see that they had somehow acquired my NEW debit card number and expiry date. This card was issued in December 2008 as my old card was broken, and I certainly did not inform them of this fact.

I immediately called The Post Office insurance helpline and was advised that they are automatically updated with policyholders’ card details by Visa. I informed them that they were NOT to take any monies from my debit card. I spoke with my bank later and their customer service adviser called card services on my behalf and informed me that they do notify companies with updated customer debit card information.

Is this correct? Surely this contravenes the data protection act, and is also a breach of security and customer confidentiality?

I would be pleased to hear anyone’s clarification regarding this matter.

    This is definatley a breach of the data protection act and if i were you I would get written confirmation from the post office as to where they recieved your new details and also a letter from the bank confirming that they did not send out your details, also a copy from Visa themselves. Then you should seek higher authority help to resolve this situation.

    What do the original documents say? They ought to cover this scenario somewhere.

    I suppose the only thing to support the action is that leaving you without insurance at all could cause really big problems, if you had thought you were covered.

    It doesn't matter whether they have the new card number or not. You have given them a CPA (continuous payment authority) - check your original contract - and your bank would have to honour the payment even if they used the expired card details.

    The best way to cancel is to inform the post office you don't wish to renew and confirm in writing.
