2 Children on DLA I get carers allowance for 1, can my partner claim for the other?**

Options
Hi there,
I have 2 children with disabilities in my house (my own sons)
My eldest son has been on DLA for a few years now, but just today my youngest son has been awarded DLA also.
I already get Carers Allowance for eldest son and am aware that I cannot get Carers Allowance twice (for more than 1 person/child).
We live with my partner who I am not yet married to but we have just had a baby together.
He is not the father to my 2 sons that are on DLA but would it be possible for him to claim CARERS ALLOWANCE for my youngest?
He works 40 hours but may be about to loose his job due to the recession.
Have I been told right that I can't claim for 2 children?
Should I inform Child Tax Credits or wont it make a difference to them?
Thanks so much to anyone that can help/ give advice xxx

  • Hello QUEENY,

You have been informed correctly, that regardless of how many people you have in your household that qualify, you can only claim one lots of carers allowance.
I am in the same position, I have 2 children that receive DLA, MRC and HRC, but I can only claim one CA, even though it takes twice as much juggling as a single parent.

If your youngest has the middle rate of DLA, then if your partner's circumstances change, they will be able to claim carers.
There is an earnings restriction of £95 per week after allowable deductions.

If your partner's employment ceases, then you will receive allowances for CA.

Here is a link to the Direct Gov website that explains it.

With regards to tax credits, you need to notify them that your child receives DLA, as there are premiums for this. I don't think you need to notify them if someone receives CA for the child.

You can claim carers allowance if your partner works but only if he earns ninety pounds or less. Anymore than this he wont get the carers allowance. .
He also needs to show that he cares for your son up to thirty five hours a week.
