Non-refundable Deposit

Was wondering if any readers had any advice on my situation?

I started a course and paid a non-refundable deposit. I have since left the course, however during the course I have obviously incurred fees for tuition and materials.

However, whilst trying to obtain a refund for the fees paid for this course, the non-refundable deposit isnt being used to pay for any of the tuition/material fees incurred.

ie.
Course Fees paid 2000GBP
Non-refundable deposit 500GBP
Course costs incurred (tuition fees and materials) 1000GBP

Now i would expect some of the 1000GBP of costs incurred to be paid for from the non-refundable deposit, so the refund I thought would be 2000+500-1000 (=1500). However I'm only getting 2000-1000 (=1000GBP)

Am I wrong in thinking the deposit counts towards the costs? If i had not started the course then i would have expected to lost the deposit, but not if i started the course and paid up the fees already.

Any advice would be appreciated, especially if someone has been in the similar situation.

    so did you pay £2500 in total or £2000, just got a big confused:D Also do you still have the information on the costs of the course and information on the course that may state something about cancellations etc?

    You owe the entire cost of the course unless the contract contained details of refund entitlements due to your cancellation.

    If there is no agreement for refunds, then anything you get is a bonus.

    If there is an agreement for refunds, let us know what it is.

    The 'deposit' is part of the course fees and should be included any refund calculation (if any is due).
  • hjb, I paid 2500GBP, there is nothing else in the T&C's about the non-refundable deposit with respect to cancellation. There are details of the course fees that will be available for refund should a student withdraw.

    phlogeston, there is a refund agreement for certain items/materials that I have not yet used in the course but would have done if i had continued. - So you agree that the deposit is part of the course fees and is available to cover any course costs incurred in any refund calculation

    thanks to you both for your advice so far. looks like i might need to get a legal opinion if the school still believe that the non-refundable deposit cannot be used to pay for costs incurred.....
