Continuous Employment and Redundancy Pay

I've been told that i am being made redundant shortly (end of month). I have a meeting tomorrow and the proposal is that i'll receive only the statutory redundancy pay.

I have been working with the company for 2.5 years (started full time in July 2006) HOWEVER, i was offered the job (and signed my contract) in September 2005 shortly before i returned to University to complete my final year.

My question therefore is do i receive 2 years or 3 years redundancy pay? Taking my contract at face value it is signed on September 2005 and therefore this shows that a position was being held for me.

I have spoken (briefly) to ACAS who have suggested i may have a good case but i cannot find any concrete answers to confirm this and i would like to be able to go to my employer with hard facts.

any help would be great

    In my experience job offer letters normally give the date when they expect you to start work - does yours ? And when did they actually start paying you a salary ?

    Contracts can be signed months in advance - and often are. Its the date when you started that matters here.

    Otherwise someone signing a contract for a new role and then needing to work 3 months notice with their current employer would be effectively employed by 2 companies at the same time.

    I appreciate that you were at Uni but the same principal should apply and I would be surprised if your firm gave ground for any reason other than goodwill gesture. Worth a try tho!

    It's the date you started that counts. Most contracts state that previous service does not apply and usually state when continuity of service starts from .... does yours have that in it anywhere.... personally I don't think that yoru argument will fly but good luck!
