RPO 8 weeks are passed

Options
Hi all

I really hope you can help me, I have called ACAS and the RPO and no help at all!

Heres a very very brief outline of the situation

Current employer in financial diffculty, empolyees told 3 days before Feb pay due we wont be getting it as no money to pay us however there is a pre-pack deal in place, just waiting for it to be finialised youll get paid by new company as soon as. Skip forward 4 weeks and still nothing! We have now been told once the pre-pack goes through we will have to claim from the RPO for wages owed (grey area again dont ask! Employer has said he has legal advice and we can claim from the RPO as well as be transfered to the new company which is the opposite of what I and my collegues have been told by various sources)
Anyway, this is the 8th week of not being paid, if this carries on past this week where do we stand? Current employer wont commit as to where the money will come from if we continue to come to work. If we dont come to work is that unauthorised abscence? None of us want to go down the grivience, constructive dismissal case as at the moment at least we 'have a job' (were in a town where A LOT of redundancies have been made and unemplyment is high) but equally we dont see why we should work for nothing?
Can anybody advise? Like I said, I have called a couple of places and no help whatsoever!
Thanks in advance

As far as I am aware you have accepted the change in conditions to your employment contract by continuing to work after your due pay date although I am not sure whether 8 weeks on it would count as constructive dismissal or unauthorised absence if you didn't go to work.

I would have thought that it would be your current employer that was liable for your wages until the business was 'sold'.

Have you legal help with your house insurance ? If you have then it might be worth giving them a call for definite legal advice.

(What does RPO stand for? btw?)
