I (scan) read an article on this today - apparently it refers to A's position being made redundant but for some reason they don't want to get rid of A. So he is 'bumped' into B's position and it is B who is made redundant.
Apparently it is totally legal if done properly

"Bumping" is legal as long as everything is carried out correctly during consultations.0

I was thinking about this. I work in a team of 10, all doing the same job, but with very different skills. We have been told one of us is to made redundant. If I am targeted I will definitely argue my case based on the skills that I have. If I am sucessful and keep my job, they will have to target someone else. Otherwise what is the point it letting you have your say?LindsayO

In this situation eveyone with the same job should be put at risk of redundancy
Then you do an objective assessment to find how the employees measure up against the job criteria and keep the required number of people using the assesment to decide.
Perfectly legal and the fairest way to decide who goes.
Companies cannot arbitraily chose one person over another where the jobs are the same however - if they all do the same job they all need to be thrown into the mix and evaluated via a consultation + selection process .Go round the green binbags. Sounds like your company are likely to be breaching regulations.
What has happened so far re the redundancy? If you lay it with timings etc out I should be able to advise a course of action that may help. I am an HR Director (who is fortunately not making mass redundancies so have some spare time ...!) and have lots of experience here.Go round the green binbags.
