Selling and splitting equity

Hi,

My ex and I jointly share a house, we now want to sell and he is becoming difficult.

We have owned the property for 9 years, the last 4 years only I have lived there and the ex has paid the mortgage instead of maitenance for the children so I could continue to live in the 3 bed home. To me this was always a bit unfair as I knew that when the house sold he'd get half the equity, so maitenance for him is just like a big savings account which will pay him back dividens.

We have recently been in court over our children in a child residency case. He sought legal representation, but as I could not afford any had to represent myself. In the end it was awarded to their Dad, because of schools. :-(

My ex is now saying he IS going to claim ALL his legal fees of the court case from my half of the equity!!! Can he do this? I have never signed anything to say anything other it wold be a 50 - 50 split as I presumed it would be. I have already spoken to a solicitor who advised me that even tho the mortgage payments were maitenance I still wouldn't get more than 50% share as nothing was ever stated or agreed during the divorce proceedings in 2005.

I feel now that this man has not only took my children, but now tyring to take my share of my house too! Im seeing C A B tomorrow to see if they can shed some light on this, but has anyone got any advice in the meantime?
