csa -when both parents are still living together

I am writting on behalf of a family member. They are going through a divorce (just started). but both parties still live in the same house . The child is nearly 4. The wife has applied for csa - but is she entitled to it if they still live together ??- both parents are resident parents.

All help appreciated plse

    I don't have a definite answer,but there are circumstances where a woman can apply for benefits as a single mother when still living with an ex-so I would imagine it does happen. If they are no longer a couple and she can prove that,but are for some reason forced to live together-or he has refused to move out even though they have 'split' for instance. I have seen many instances on here that prove that it does happen and it is down to the father to co-operate with the CSA and if she is misrepresenting the situation to get suppport she is not entitled to he can put his case to the CSA.

    I do know situations with friends of mine where they have split,he has refused to leave even though seeing someone else and has withdrawn any monetary contribution to the home. Under those circumstances why shouldn't the woman apply to the CSA for support? (she hasn't but that may change!)

    But every situation is different.

    Problem here is there is no 'non resident parent', I thought one of the criteria for claim CSA was the parents were living apart. This doesn't stop the courts making an interim arrangement though.

    The wife can still claim CTC/WTC based on her income only, if the parents are living emotionally/financially apart.

    Under the old rules for claiming IS etc tho they would chase a man in this situation and the money would go to the govt-and I don't think things have changed in that there has to be some way of getting both parents to contriute to the childs care.

    I think the best way to get the answer is for your friend to phone them-then please let us know the answer for future reference!
