They are not allowed to threaten you and the OFT is finally starting to take action against them when they do.
One thing to bear in mind though - the fact that the ex was able to defraud them shows how poor their identity checks are and they may not be overly happy about admitting poor practice on their own part.If you've have not made a mistake, you've made nothing0 -

Whilst it annoys me no end when companies are so slow to look into fraud then I guess on the flip side they must get hundreds if not thousands of people claiming they have been victims of fraud to get out of paying their debts too. That doesn't excuse them from actually taking a fraud complaint seriously though, but I can certainly understand why their first react would be "yeah right... 'course you didn't take this out... 10th time today I've heard THAT story..."

I've got a CIFAS flag on my reports now, which they said they would arrange to put on. The main thing that is worrying me at the moment is that Capital One are stating that they do not need to provide me with a true executed signed copy of the agreement that they claim they have and they say that they are allowed to send only a blank template so I'm kind of stuck as to where I go from here. I know that I haven't signed anything to say that I wanted to open an account with them. The other companies that I've been going through this process with have been the same in that they didn't have my signature for anything either as they were done online and they didn't have my signature for any of the items they supposedly delivered to my address either. I really want to try and send another letter to Capital One but don't know what to put in it from here - its kind of stale mate. If it was a couple of hundred pound then I maybe would have just paid it to get rid of this whole fiasco but its over a thousand pound and I really object to paying that kind of money for a debt that is nothing to do with me. I've sent them info from the police and I've sent them copies of my credit reports that show all my accounts have been up to date and never in arrears and it doesn't seem to be making any diffference - any suggestions??? thanks again x x0
