Help please

OH has been give his redundancy payment calculation as follows:

Start date: 20/08/06
Release date: 23/04/09
Termination date: 21/05/09
Age: 28
Salarty: £27,66.12
Notice period: 4 weeks
Sevice: 2
Statutory: 2
Weeks Pa: £532.04

Redundancy termination payment

Statutory Redundancy £1,064.08
Ex-gratia enhancement (95% uplift) £1,435.92
Total £2,500

I have a few questions if someone could please advise:

1 Can he work as the day from his release date or does he have to wait for his termination date

2 Is the £2,500 paid gross?

3 Do you think his last salary will be in May?

4 When can he sign on April or May?

5 If he does government training do you think he can work a day or 2 with an agency or do you think this will effect the training?

Many thanks for your help.

Sorry to hear you are going through this
Hopefully someone more knowledgable will respond, but I do know that there should be no deductions from redundancy payments under a certain limits and your OH 2500 comes in under the limit

1 Can he work as the day from his release date or does he have to wait for his termination date. He should wait till termination date - but will the current employer know or care?

2 Is the £2,500 paid gross? Yes - if truly ex gratia for the non-statutory element.

3 Do you think his last salary will be in May? Yes - but ask. They may want to keep things simple and pay everything at the same time.

4 When can he sign on April or May? If he hasn't found something to start before or from the termination date, then he could sign on from 22 May (he is being paid up till then so JSA/NI credits not due before) but could make arrangements for an appointment beforehand I believe.

5 If he does government training do you think he can work a day or 2 with an agency or do you think this will effect the training? Depends on the course. Would need to discuss with Jobcentre.

    Many thanks for your help.
