UPDATE:
I sent letters to both LCS and 1st Credit reminding them the account is under default as it has been 8 months and still no CCA from 1st Credit.
A phone call on the 10th of March reminding them to send it out - still unanswered.
The phone calls to my house have continued.
Today I received a letter saying they have received my communication and I need to get in touch via telephone to discuss it further. Something I will not do - all they have to do is send the FULL CCA!!!!!!! How hard is it?!?
I'm getting pretty !!!!ed off now but where do I go from here? I'm already reported it to OFT!
Letter thinking about posting back:
Dear Sir / Madam
With regards to your letter dated 30/03/09 asking me to call your office, I will not be making that call. As I informed you on the telephone and by letter (dated 26/03/09) – I will not be discussing this account on the telephone. I remind you that this account is still under default by you for failure to produce the CCA I requested 8 months ago.
Furthermore, I remind you that on the 10th March 2009 I phoned into your office to request the CCA. Once again I am still waiting – although you are still chasing payment.
Due to the continuing telephone calls, from your office, and letters demanding full payment, sent from another company on behalf of you, I would like to advise you that I have passed on copies of all correspondence between us to relevant financial authorities to issue a formal complaint.
- I request that all telephone calls cease immediately
- I request a full copy of the original CCA within 7 days as you have already had since my last letter on the 26th to source this)
- I request your proposals for monthly instalment for repayment.

Please take you name out of documents.
This is no way to bargain.
If there is no CCA the debt is unenforceable and you do not have to pay anything. If they have already issued a default, there is NOTHING they can do to affect your credit rating, no way to take you to court sucessfully.
if you want to pay, then you decide what you can afford and your set up a standing order for that amount. Entirely YOUR choice not theirs. If you've have not made a mistake, you've made nothing0 -
lol DOH! Didnt realise my name was in it....!! Thanks for that.
So basically I can stop all communication with them until they pass the CCA over?
Also - they haven't issued anything to me other than more letters requesting money. Are they supposed to send me confirmation letter the account is in default.
Many thanks for replies.0 -
if they the original creditor or 1st credit have issued a default on this account, it will be on your credit record. If you've have not made a mistake, you've made nothing0
