1ST Credit.... 7 months later. PLEASE help

    Given that what they are doing is sendin g you the application form, which is not legally compliant and threatening legal action which cannot succeed if you defend the case, they are doing what the OFt has already boolocked them for, albeit a variant.

    Hi would really appreciate a little information on 1st credit.I have 2 debts which have been passed to them from the halifax ,so far all they have sent is threatening letters and an edited copy of an application for a credit card ,there are several mistakes on the application the main one being a completly different visa card number and also 2 different dates,sorry if this qoute is in the wrong place i am new to all this but have found your info on this subject very usefull ,any advice would be greatly appreciated:o

    Who is OFT and how do I report 1st Credit to them??

    Sent a letter to LCS stating that 1st Credit don't have right to pass on info / account in dispute with them etc...

    Sent 1st Credit letter stating they defaulted on CCA agreement 8 months ago and have no right to pass on information about me / continue to try and collect the cash etc etc and that I would be reporting them to proper authorities (as stated in letter).... thing is.........

    How do I go about that???? lol

    OFT Office of Fair Trading. They will put you in touch with the financial ombusman (sp?)

    Fleetbank House
    2-6 Salisbury Square
    London
    EC4Y 8JX.

    Try to just write the facts. E.g.
    On xx/xx/xx I recieved a letter from 1st Credit. Copy enclosed.
    On xx/xx/xx I wrote requesting proof of their claim on me. Copy enclosed.
    On xx/xx/xx they replied, attempting to legitamise their right to the debt with document supplied.

    Etc, etc.

    Have been going through all the letters typing them up to OFT as requested (basic facts and I will include copies of the letter)

    Just noticed though, 1st Credit aren't stupid, they DIDN'T date the letter that accompanied the front page of the CCA so there is no proof of when I received it!!!

    The only thing that ties in with it - is the phone calls that have started again, started 2 days after the front page of the CCA was sent.

    Surely with no proof - a complaint would fall on deaf ears?

    I would expect thay take your word on that. It should't be a problem.
    Edit - the core of your complaint is that the CCA wasn't proof of the debt but they are still chasing you. Not that they were late.
    The only thing that ties in with it - is the phone calls that have started again, started 2 days after the front page of the CCA was sent.

    Surely with no proof - a complaint would fall on deaf ears?

    An email to accompany the main letter to OFT:

    Dear Sirs,

    I have seen that you have taken action against 1st Credit but I wish to make a complaint as it appears they haven't taken any notice. All letters can be provided as proof if required.

    On 28th July 2008, I sent a request for a CCA as they were chasing money owed to another company (not that I was made aware of this by the other company).
    They sent a letter back stating they didn't have it but would source it from the company I actually owed the money to.
    I heard nothing back.

    21st March 2009 - they sent one page, with an undated letter, (a page with just my name and address on it) and said that, if it looked correct they would send the rest). I phoned and told them it may have been the correct one and to send the rest.

    23rd March 2009 - they have sent my details (despite being in default for the CCA) to LCS Solicitors who say I have a week to pay the outstanding balance or face court action.

    Since the 21st there have also been numerous phone calls requesting immediate payment - one of the calls even stated I should borrow the money off a friend or family to pay them back.

    In my letters to them I have done nothing but request the CCA and ask them for details of a realistic monthly payment that I can make as there is no way I can pay the full amount.

    Please advise where I should go from here.

    Photocopy the envelope, and include it within your complaint, that'll be good enough proof regarding when the letter was issued.
