Redrow won't let us out of Missives

Just out of curiosity, what are the penalties for revoking the missives. I have vague memories of this from my own house purchase six years ago. I dimly remember that it would have cost me a couple of thousand to pull out. Might be worth paying the amount and cutting your losses?0

Good question, don't know as redrow won't let us pull out, we don't have the money to buy it but they won't let us out of it either. Looks like its going to end in a court case. Im glad your house builder whould have let you pull out unfortunatly Redorw scotland won't let us, despite the fact we've told them numerous time that we don't have the money to move.
The weird thing is someone in the sales team actually thought we had pulled out, the letters that Redrows solicitors send us say the will take us for everything they are entitled to. They really are a company that don't have a clue what one part is doing in relation to the next.0 -
What is your solicitor advising you to do? Is he saying the contract is enforcable or not? Does he suggest anything you can do?0

I don't think it's inconsistent at all. The sales team have been told that you aren't completing, so they should try to resell the property, and the lawyers have been sold to sue you for breach of contract. It's logical.No reliance should be placed on the above! Absolutely none, do you hear?0 -

no its not, redrow can't resell the property until we fail to complete and redrows laywers have told us we must complete.
So at no point currently can redrow build this house to any other specification than ours and they can't sell it to anyone else either.
If they would accept the fact that we can't complete then they can sell it on but redrow solictors won't accept it.

You are due to complete around the start of May (speaking from memory), so they'll serve a completion notice on you in two weeks time and take it from there. That will crystallise things pretty quickly, so they can exchange contracts with a new buyer by around mid-May. They could have if they hadnt put it back again to June. What I'm complaining about and trying to warn others about is how we've been treated like dirt by redrow, how Redrow have lied to us in letters, struggled to make any descisions and certainly not any fair ones.0 -

And people keep saying they've treated you pretty fairly, based on what you've told us. It's not their fault that house prices have dropped. I admire the way you have stated your opinion throughout this thread despite leaving yourself open to abuse. It seems that there are differing rules dependent whether you are a layperson or a company. The companies are not charities so why do people expect to be let off - a mystery to meA retired senior partner, in own agency, with 40 years experience in property sales & new build. In latter part of career specialising in commercial - mostly business sales.0 -
Builders Missives are totally biased, there should eb a law to stop then from making such one sided contracts
There is.... common contract law.
Anyone is free to write a contract with whatever terms they so wish in it, the other party is free to accept or reject these, no-one forced you to sign, you did it freely.
Maybe you should write to the papers and the MEP about the worrying state of buck-passing and complete disregard for contractual responsibilities shown in this transaction - Oh and in case you hadn't worked it out, I'm suggesting that it's you who is at fault 100% redrow have done nothing wrong.The proof that some people really are opinionated and ignorant
