Rights on faulty ring

My husband brought me an eternity ring for Christmas from an independent jewellers which was too big for me. When we took the ring back to get it resized the manager assured me that the ring could be reduced in size without distorting it. The ring was reduced from a size M to H. A week after getting the ring back, one of the stones came out and the jewellers sent it off to be replaced at their cost . I have had the ring back for about a month and the same stone has came loose. I took it back and the manager is now saying that because the clasp is missing that it is damaged and not faulty and that I will have to pay for the repair. I have not done anything to damage the ring and feel that this is extremely unfair. I believe that it is not fit for purpose as I shouldn't have to remove the ring to do every day things. I feel that the damage is down to the ring being reduced by too many sizes and that the shop should take responsibility. Does anyone know if I have any rights? Can I ask for a refund?

It has been bought within the last 6 months and so the burden of proof is on the retailer to prove that it wasn't faulty.
I think in the case the evidence is on your side (particularly given the previous defect) so hold out.0 -
I don't trust re sizing, I got a Ring for xmas size K and wouldn't have it resized even down to my J size. I got a new one.
I think you will be lucky if the shop do anything, cos at the end of the day they got the sale which they wanted!

I worked at a jewellers for a time and was always told that its best only to resize 2-3 sizes. More than that is possible for a solitare ring, or occasionally 3 stone, maybe 4-5 sizes, but with eternitys its very hard to amend without affecting its shape and stability of the stones. M-H is quite a difference, especially with an eternity. Even if it were resized fine is shouldn't have broken so often in so short a time, clearly theres some sort of fault if its the same stone.
I'd definately push for a refund or exchange, or atleast properly fix it! just not acceptable! Maybe take it to others jewellers to see what they think of the condition for some more information to push your case.
Was it gold or platinum? If platinum then it should definately have lasted better (not to say gold sho9uldn't have either). And look closely at the setting of the stones, some settings should really not be resized much at all to keep them strong and secure.
