sorry I have a sick and twisted sense of humour (some people find it too much naming no names) so I kept it mild as I have already upset someone today ...

I have never waited for references to come through before resigning - I have ALWAYS waited for the job offer and salary confirmation etc in writing however. Your previous employer can not give you a "bad" reference - most companies have a policy of only giving your a minimal reference: ie "A worked here from x till z and carried out the duties of blah". Any "good" references from bosses etc you often have to ask for them to be personal references for - and I'd hope when you pick your references you pick ones that would give you a good refence.
I have been in situations where I have refused to give references for people which probably didn't help them get their new jobs but the official reference from the company was always issued and done by HR and not me and they have to do it by law.
Anything above and beyond is down to the referee... And if i didn't think you were good enough to work for me I wouldn't write one as I wasn't legally obliged. Then again - you'd think people would have the sense to ask someone before putting them as a reference on their next job application ;) I know I always ask my references before putting their names down... even if it's just as a matter of courtesy :)

("Law" about having to give a reference is for restricted jobs, most people are not included. Company "rules" on this are not "law".)

That's a risk the employer is taking. If they make an offer subject to receipt of satisfactory references but then let you start work, it has to be assumed that this is because they have been satisfied with references received. If, subsequent to your start, they decide the references don't satisfy themselves then they have to go through proper dismissal procedures.
