The other Insurance company is stalling on the pay up bit!
....and in these current times a cry that is all to often being cried out by victims of car accidents.
So heres my story...
On Jan 4th a lorry side swiped my car, a 14 year old Frontera.
A shame and really annoying, I'd always wanted a 4x4 this one was cheap and also the model I'd liked as a kid.:D
Anyway, I'm at home on holiday watching TV, when I see the lorry break hard next to my car. I get up and look out the window to see him start to reverse.
As he reverses I see the wing mirror on my neighbor's car "unfold"...yep he hit his car.
So I grab my keys, go out side and offer to move my Fronty to give him more room....at which point he apologizes to me and points to my car.:eek:
'Mr. Lorry' had swiped (scratched/scraped) the rear quarter of my car, broken my wing mirror, scratched the back door, and broken the side indicator, destroyed the wheel arch 'spat' .... all in one go!:T
We swapped details, and he went on his way.
I stood looking at the damage then took some pictures, and went in.
My house phone had some missed calls, I called them back they were his offices!
Cool! they want to solve this quickly!
As I talked them they were up for sorting the accident in 24-48 hrs...I was over the moon!
A couple of days versus ages through the insurance company.... great!
I agree to a private settlement, on the understanding that my Fronty is looked at that night. They agree, so I waited.
I called the office 3 times trying to confirm that they were going to turn up...no answer.:huh:
The next day I call them in the morning to find out what had happened, the voice on the phone had no idea what I was talking about.
So I stated I was calling the insurance company and we were now going to resolve this problem via them.
Some time later late that afternoon, the office calls me back, reporting that the chap who was to undertake the work had not turned up.
They had not received my message, so I told them what was happening and to expect a call some time soon.
Well that was then, my Fronty has been written off and sold on since then, as far as I am aware the new owner has repaired it as well...good for him.
Today, the insurance company claims to have released a cheque to me, one that has been stopped, and confirmed as never cashed, to then release a second cheque to me that has also never been received and so stopped and confirmed as never cashed.
Now the good, bit, they admit liability, they have agreed payment.... but passed the case to another company to deal with.
This third party has decided to inspect the car! :rotfl: :silenced: :mad:
You know the one I sold after it was written off as an uneconomical repair.

Getting rid of the car before you had a payout and final settlement was foolish.
Whose to say the car ever existed or was damaged....0 -
after the car had been deemed a write off did you get it in writing to say keeping the car was part of the settlement deal ?
my sons car was written off on the 6th Jan and he is still awaiting a decision after two inspections, they both agree it is written off, our assessor says he can have it for a £50 charge off the settlement price the other assessor says no way, they all have to go for salvage ???
Personally I wouldn't have got rid of the car before i had the paperwork and cheque in my hand

The car was actually 'brought back' by me, the car was inspected and written off it was either that or the car was taken away and crushed!!
I loose the car either way!

Who have in my opinion messed up, and involved yet another group called CNS to review an old'ish case.
I'm thinking these guys (CNS) are the fraud team for Tradex, and CNS have spotted or become concerned/aware to some irregularity in the case notes.
It's the first time I have suffered a 'total loss' so I was not very worried that it was taking longer than many accidents and cases I've had friends go through.
I had already voiced my concern that the lorry driver was not insured to drive but everyone told me he was.
Right up until the case was passed to CNS I assumed that all was fine and that the matter was all but over........ why? easy....
Tradex admit liability, the other driver had admitted fault, the car was registered with DVLA as a write off.... all I had to do was wait for payment and get another cheap run around.
Now involve CNS and I start to really worry. It takes them ages to report they don't have all the paperwork. Again I worry Tradex have messed up.
It takes days to get them to actually read the notes, then I discover they decide if payment is to be made. HUH!
Tradex claim (now) they have sent two (2) cheques to me....
I call CNS and explain that liability is agreed payment is all that this matter is waiting for and it can then close.
They claim they don't use computers hence things are slower for them. My own research shows they deal with suspicious claims..... so is there a fraud aspect to this case or do I revisit the possibility that the lorry driver not actually insured !
The person I feel messed up at Tradex has been asked for his managers contact details...still waiting for them, this makes me think that the claimhandeler at tradex messed up and had messed the notes up making CNS concerned for all the wrong reasons.0 -
If your car was inspected, Tradex will have an engineers report. Ask them for a copy of this, as it is your evidence that the car was a write-off.
If you have any concerns over the validity of the third party insurance, phone the police and register a complaint, advising you are concerned that the third party may not have been insured at the time of your accident with them, as you are not receiving any assistance from their alleged insurers.
Finally, phone the third party and ask them whether they would like court papers issued directly on them or to their solicitors as you are sick and tired of waiting for their useless insurers to deal with the matter.

My research ..scetchy as it is does support that!
Well I have called CNS offering to call the police to have the driver investigated, and even call the FSA to have Tradex practices looked into...
The responce:
We'll issue payment and send it recorded delivery.
So my next question will be:
'Whats the tracking number?'
Some how I think my next phone call will be to the Police, the FSA and maybe a visit to the court to get papers set up and served!

I think I know exactly whats going on at the moment with the claim knowing Tradex but quite long winded so won't go into it on here.
You really really have to keep on to Tradex.
When they tell you they have sent the cheque, ring the next day to get the handler to confirm it has been sent. Then as you say ask for the tracking number so you can ensure it has been sent.

Had it in mind that the 'case' was going to do one of three things:
1. Run for ages, and eventually solve just before legal actionwas taken.
2. Clear up as it was an honest oversight.
3. Going to solve because some mad man kept caling them and calling and calling them !!
Yup! I took option 3.
Called them daily, I was also lucky in that I had mail addrress as well...so I mailed them and the network admin!
Funny thing about computer networks, the admin has a mail account normally called admin @ <company name>.com :rotfl:
I finally called them asked for managers names was bluntly told to 'sod' off, so reported them to the FSA.
Got the cheque just before the hols.... from not Tradex but CNS!
Seems CNS lied about who pays the bill.................
The matter is solved...finally.....:beer:..... I had low expectations seeing as I'm the 'third party', and Tradex met every single one without failure and with amazing consistancy, as did CNS.
Another Question for anyone:
The FSA, are all but worthless, so who can victims turn to put an end to such stupidity?
It's madness:
For the sake of a small payout to me, Tradex now have a 'Hire car' bill to pay, a bill that I estiamte to be in the thousands........ thats next years premium increase!
