Rights when sent wrong item

I ordered a DVD from Play.com and was sent the wrong one. I reported it to them and they said they would send me the correct item but I have to pay for it to be returned via recorded delivery.

Surely they should pay for their mistake?

Was just wondering if anyone knew what my rights were regarding this?

    As far as I know i think they are only legally obliged to pay for return if the item was faulty. However , It is well worth checking out with your local trading standards

    I'm sorry i could not have been any more help but i think it would obviously be morally correct for them to pay because it was obviously there mistake.

    If you can , can you please update us on how your going , i would be interested to know how if they have to pay legally

    Hi,
    When I had to return to Play the told me that I pay but when they get it back they credit your account with the postage. So although you do pay it to get it back to them they refund you hth.

    Just want to confirm this, I've had the same experience, Play.com have always been good in my experience. A flatmate once didn't receive a DVD, they phoned to say it didn't arrive, 2 weeks past and it didn't arrive so they sent a 3rd copy with no fuss which arrived.
  • A quick reminder however that if things did go wrong, as Play.com are based in Jersey, you would have precious little recourse.
