Insurance company agreed to pay out - now they changed their minds

Bike got nicked in December 2008, they have not yet paid out as agreed despite numerous complaints. I got the Financial Ombudsman involved, they sent my insurance company a letter asking for a final response. The insurance company sent a letter saying they know the ombudsman is involved and will get their response sent.
Today I received a letter from the insurance company saying they will not pay for the claim unless I give them proof that the bike was repaired after an incident that happened over a year ago now. They didn't ask for this until now, all they asked for was photos of the bike before it was stolen which I provided. Can they do this after they agreed a figure to give me?

If the bike was not repaired following the earlier accident then it will have been worth a lot less than what they agreed. Did the earlier incident go through insurance? If so, they should have the records. If not, do you have the repair bill?0

Proof needn't be the bill/receipt. If you can show the transaction on your credit card/bank statement, that will do.
If it was a cash payment, then, (unless it was on the black economy), the garage should still be able to supply you proof the repair was carried out.0 -
I don't have a repair bill, they have all of my documents they asked for and I got rid of everything to do with the bike once they agreed to the figure they will pay me.0

A premature evacuation of the documents! Always wait till the cheque has cleared before destroying the file!
But all is not lost - see suggestions above on getting the proof they now want.0 -
I wonder why the insurers are suspicous!!!
A previous incident, no bike and no proof it was ever repaired - I assume after a previous pay out.
Whyever would they be suspicous.0 -

The bike was recovered by the police.0 -
so you will be able to get someone to examine it and confirm it was repaired after the previous fault then.0

Why cant the garage that did the repairs issue a copy of the job done?I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only.
