What to do?

I asked my bf to buy me some GHDs for my birthday and he went and got some off gumtree (d'oh). Surprise suprise they are fake and no reply when emailing the seller.

He paid by paypal and has no address for the seller. Is there anything he can do? GHD website says to contact trading standards but without an address or contact apart from a hotmail email what can they do?

    surely paypal already has the sellers details? with a contract/sale reference etc, cant they do a chargeback to the related chargecard/bank account?
    Long time away from MSE, been dealing real life stuff..

    you can't do a chargeback if you paid directly from the bank account, only from a credit card. I've tried that :-(

    so if we contact trading standards nothing will happen? I read somewhere that you can do a small claims but we don't have the person's address so is that option ruled out?

    I thought you could still raise a paypal dispute even if bank funding was used? Raise a dispute stating they are fake, you may be liable for return postage costs but at least you should get your money back, or at least it'll get the seller to start responding.

    Although I did hear somewhere on here that you don't need to return fake goods...not sure how accurate that is.

    I have tried raising a paypal dispute - I escalated it to a claim but their response was that they can't do anything. Selling counterfeit items is a breach of the user agreement but paypal don'#t seem to care

    might be worth reporting to police or at least trading standards, in case the seller is doing more people.

    and also GHD themselves? they arent coming out of this too well, by association.

    Suing anyone (especially Paypal) in this case is just throwing more money away.

    Get in touch with Paypal for the seller's address, which they probably won't give you. Also ask Trading Standards.
    How did you put the claim through with Paypal?
    I've never used Gumtree, but is there not a way of getting the address on there?
    You can also get details from the email address, or at least contact the ISP of the email and let them know how it is being used.

    It may be just a case of having to let it go though.

    To be honest, there is a bright red message at the top of every page on Gumtree saying don't pay before you see the item and that they do not offer any payment system. A similar thing happend to me but with an Xbox 360 but it just didn't arrive. Luckily I got my money back but I think you should just see it as a lesson to be learned and realise Gumtree is a local website for local people to trade, and it is not similar to eBay.
