    Are you certain about this?
My understanding was that the responsibility for due dilligence falls entirely on the seller and it's a "sold as seen" situation.

Firsthand experience with the house one. Even got to the stage of a debt collection agency but as they had rectified the "faults" themselves (supposedly) they hadnt a leg to stand on.

Scots law and english law does differ though.

Just out of interest are you entitled to have cash as an alternative.
e.g. if someone put a scratch on my car but it was only cosmetic and I wanted cash, am I entitled to that and do what I want with the money, or a, I strictly only entitled to the repair.

My legal expenses only allow repair- trouble is they pay up front and claim from other party- not happy with this as matter might be disputed and a "pay out has been made on my insurance which has to be recovered"

    Don't follow.

Your op said you only had third party insurance, and asked for advice on how to write a letter.

Now you tell us you have "legal expenses" - why aren't they writing letters for you?? And which insurance has already paid out for your repairs??

from the OP's last post, sounds like they are onto a Credit hire company, who have repaired the vehicle under a credit repair scheme.

I could be wrong but the OP is about as clear as mud.
