Faulty Car, what are my rights??

Hi I was hoping to get some advice....

I purchased a 2005 reg Vauxhall esate car from a well known TV advertised car supermarket on Dec 12th 2008 (3 months ago). The car cost £4,495.

Since purchasing the car I have cover an additional 12k miles taking the mileage upto 48,000 from 36,000.

The other day I started having trouble with the automatic gearbox and the engine warning light came on so I immediately took the car to a local Vauxhall dealer for a diagnostic. They came back to me and said that i had oil in the coolant and coolant in the oil and the car would require a new gearbox and engine flush costing thousands of pounds (£2k just for the new gearbox).

As the car was 10 months out of the manufacturers warrenty they couldn't do anything to assist me other than carry the work out and charge me. I then contacted the car supermarket who sold me the car and they weren't interested, saying that as I hadn't purchased an extended warrenty I wasn't entitled to any assistance from them.

Vauxhall might still have helped as they wouldnt have expected a car of this age or mileage to have this trouble but only if the car had a full Vauxhall service history. They however failed to trace the first service on the car so then declined to help.

Have I got any rights under the Sale of Good Act to get the cra repaired by the car trader that sold me the car 3 months ago?

I would appreciate some advice

  • No. Your car is faulty and needs repaired and you will need to arrange this.

    Without a full service history Vauxhall won;t contribute to the repair bill.

  • I'd say not. You have covered 12000 miles since the purchase and parts will fail at some point in a car's life. It's unlikely the trader would have known that there was a problem when they sold you the car, not if you've managed to cover that amount of mileage since you bought it, and in all honesty, it was unlikely there was a problem when you bought the car. 4000 miles per month is a lot and it's more than likely that what you have here is just normal wear and tear.

    just don't take it to vauxhall. go to a reputable non franchised dealer. i bet the cost will reduce dramatically.

    Thanks guys you're probably right....I've found a local transmission expert who can recondition the gearbox for a quarter of the cost
