BMW Brake Pipe!

Hi,
I had an accident on 01.01.09 in my Mini. It was collected by a company arranged by the insurance and taken to a garage for repair. The damage done was to the suspension and brake pipes. I am still waiting for the car to be returned because as yet it hasn't been repaired. I have contacted my insurance company on several occasions to find out what is happening but they do not seem to know so I contacted the garage myself, and they informed me that they are waiting for the brake pipes to be delivered from BMW. My main problem is that as yet nobody can give me a date as to when I will receive my car back and I am still paying both finance and insurance for a car that I don't have nor will I for the foreseeable future. Is there anything I can do? Surely there must be a point when the car should be written off? I haven't even been offered a courtesey car to use because of the long delay. I feel that the insurance company just keep fobbing me off. PLEASE HELP!:mad:

Was the accident your fault? If not, you could consider getting a hire car, and claiming the cost from the third party (along with all your other uninsured losses).0

If the garage is waiting on parts then there is often not much they can do, it can take time to get them from the factory, but this seems like a very long time.
Have you made a formal complaint to the insurer? (Assuming it is your insurer). From the basic outline you have provided, they seem to have failed to keep you updated with the progress of your claim, but have offered you a courtesy vehicle so maybe you already have. I assume you have taken them up on that offer? Otherwise, take Quentin's advice if possible.
"Writing off" a car is done when the vehicle is beyond economical repair, or/and is unsafe to repair. If the cost of the repairs exceed the market value of your car this would mean it is usual written off, how long the repair takes makes essentialy no difference to the insurer.
You are liable to your finance company for the debt and that is quite separate to the insurance. Also, you may have to pay the insurance in full anyway now you have made a claim - check your policy.

That is a ridiculously long time to wait. I would contact your nearest BMW dealer and ask them if they can help.
