already claiming carers allowance, can i claim for dla for myself?

hi,
i have 2 children that claim dla for. one recieves high rate care and high rate mobility and the other recieves high rate mob, and mid rate care. I claim a carers allowance for them.
I suffer myself from cfs/m.e, and am having a particulary badly managed time at the moment! im awaiting an appointment at a clinic.
Can i claim for dla for myself if i am a carer also?

  • I would imagine not, it seems difficult to imagine how you could possibly 'care' for two severely disabled children if you are disabled yourself.

You can work and get DLA so there's no reason why a carer couldn't get it.

I receive DLA for myself as I have multiple sclerosis and having an underlying entitlement to carer's allowance (nothing is paid as my SDA is too much) for my 16 year old son who has Asperger's and receives DLA. The only time I can see it would cause a conflict is if your caring involved a large amount of physical activity, such as lifting, which contradicts your DLA award.

Of course it all depends what the disabilities are,for example mine is neurological and my wifes physical,we both claimed carers at one point,we now get sdp which pays more.
But as a general rule providing you meet the rules then its perfectly ok to claim carers and dla
  • Hello frugalmumof4,

Put in a claim for DLA for yourself, don't wait for your clinic appointment. Remember that DLA can be awarded without a diagnosis, it's the care that you need.

Dependant on what other benefits you are in receipt of, will affect carers allowance.

Even thought both your children meet the criteria for carers allowance, you can only claim one amount.

There is no problem with receiving CA and being in receipt of DLA yourself, if awarded. This is because often a disabled husband would care for a disabled wife and vice versa.

    Good luck,

Well, let us look at the evidence.

Both children have severe mobility issues. In laymans terms, it would seem unlikely that the children could walk far/at all, and may very well be confined to a wheelchair.

Both children are also receiving the care component, one of which can be assumed to be requring almost constant care and the other can be assumed to be requiring a significant amount of care.
I suffer myself from cfs/m.e, and am having a particulary badly managed time at the moment!

This would suggest that the person is unable to care for the children in an effective manner. Yes, you can work with DLA depending on your needs - but someone with ME/CFS on a serious scale simply cannot care for two disabled children.

I would be very hesitant to open a claim for that reason - it may very well be questioned just how you can care for two children with ME/CFS symptoms. Certainly, the individuals I know with ME/CFS symptoms can barely care for themselves at times, let alone others.

I get dla lm'mrc and have claimed carers allowance in the past for my daughter. I did ask the carers allowance about it and they said that just by the fact she lives with me and i live alone with her means i qualifity for the 35 hours a week rule. OK she did not get the "care" that she would have got living with someone who did not have my problems but i did an adaquate job. I think it is all more of a legal thing than anything else as i hear of many people claiming ca when they get dla and no one bats an eye.

This is not a court but a forum so no need to look at any evidence.

The OP should look into claiming whatever they are entitled to.
