Hi All (it is credit card related)

Dont know if you read my thread in the money saving arms. But I got robbed yesterday in france.

I purchased about £300 of ciggys and booze in belguim on my credit card. I have all reciepts as proof of purchase and police report to confirm robbery from my car.

Now the question is, can i claim the loss back from the credit card company? i called them yesterday to report the theft, and they said that i could not claim because the ciggys were classed as pherishables (sorry bad spelling). Is this correct and would i be fighting a loosing battle in trying to get the money back.

  • Must admit that the bods who broke into my car were bloody good in getting in, no damage to bodywork whatsoever, just killed the lock. But they were also thick. if they took the time to check they could of got loads of other bits and tools which were far more valuable than the ciggys.

    Only problem being is that what was ment to be a good saving has now cost me a small fortune. oh well.....

    A recent ruling confirmed that purchases abroad are not covered by your credit card.

    Some cards have said they will go on covering you but they don't have to. If they choose to pay you then great, if they choose not to there is nothing you can do about it. Sorry.

    Did you wish to claim under the provisions of section 75 of the Consumer Credit Act 1974?

    Under this Act, if something goes wrong with a purchase of goods or services as a result of misrepresentation or breach of contract by the supplier concerning the supply contract and he fails to provide redress, individuals should usually be able to claim against their card issuer. This isn't the case here; the supplier must have fulfilled the contract as you had taken delivery of the goods.

    If you wish to claim under the provisions of any "Purchase Protection" policy provided by your card issuer, you will have to read the terms and conditions of that policy to see whether your claim is excluded.

    BTW, may we know which card is involved?
