I would suggest they DO have the resources, given the millions in profit they make. An 18 month contract should be just that, unless you opt back in. The default position should be that the contract ends.

    Simple. Common. Sense.

The day that the final installment was taken from my bank account I cancelled the direct debit. As far as I was concerned the contract had finished and been paid for in full.

    Hi Andy,

The above bit quoted is your mistake. You need to actually WRITE to them stating that you wish to terminate your contract at the end of your 18 month minimum term. If you phone to cancel, you need to make sure you get written confirmation that it's cancelled!

Legally, you will have to pay February, March, and probably April, and you need to write to them ASAP stating that you want the contract ended. Send it recorded delivery to make sure they get it!
Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

lol. I bet if you didn't realise the 18 months was up and they cancelled it you'd have been !!!!ed off aswell. Obviously an 18 month minimum contract period doesn't mean it ends after 18 months.

So anyone can just say this is unfair then get out of it under UTCCR 99?
    Not at all.

But if a company breaches the UTCCR by trying to impose unfair terms and they are found guilty of doing so, then those terms are non-enforceable.

Why do consumers always have to blame the companies instead of accepting they've made a mistake or were careless?

Companies exist to make money, everyone knows this, and as such people should exercise caution and COMMON SENSE.

Consumers need to stop expecting companies to wipe their backsides for them all the time.
and companies should operate to make those profits within the law. If they don't, they have to expect to be brought to task sooner or later. They already have the upper hand in so many aspects and rely heavily on the sheep not questioning anything and expecting to do what they're told whether lawful or not.

An automated letter at the 17th month on a system already geared up to send bills monthly and contracts, a drain on their resources? Who are you kidding? :p

Surely you're not serious?* If Orange have the resources to text me when my bill is ready, when they've reviewed my plan (even if they have nothing useful to say), when I go abroad and when I get a new magic number, then I'm sure that a text from your mobile phone company to say that your contract expires in 30 days is more than possible.

*The proper response, irrespective of what I write next, is "I am serious, and don't call me Shirley". You know you want to.
"MIND IF I USE YOUR PHONE? IF WORD GETS OUT THAT
I'M MISSING FIVE HUNDRED GIRLS WILL KILL THEMSELVES."
  • I am serious, and please don't call me Shirley. :p
