sorry if im in the wrong section but the carphone warehouse has placed a default in my credit file after i missied 1 maybe 2 payments, i never recieved a default notice or any other notice for that matter, surely this is wrong and they should remove after i pay. any help greatly appreciated.

    Did you make the payment?
    If not, then what would you reasonably expect a company to do?
    Did they write to you at all?

    i never recieved a default notice or any other notice for that matter

    Did you sign a contract saying you would pay your bill by a certain date each month (i.e. by cc or dd)? Did you then miss these payment dates?

    If the answer to both of the above questions is yes then they have behaved quite correctly and the default notices should stay on your credit file.

  • I have missed 2 payments, but i never recieved any notice that they were goin to default me, surely by law they have to serve a notice with intention to default before actualy goin through with it

    so u thought if u just DONT pay for 2 months life is joggy?!

    they bill you 2 weeks before payment due... if u then dont pay for 2 months then you are at fault. how much notice do u want?!

    So you assume there is a law that allows you not to bother paying whenever it suits you, but requires them to get your permission to place a default notice on your credit file.

    To be fair our politicians are a corrupt bunch of idiots, but I suspect that would be a step too far even for them.

    Start a petition on the 10 Downing Street website, then even more people can laugh at your demands.

  • I thought that a default was different to a missed/late payment and that there was some sort of procedure that they had to go through before putting it on your credit file.
    If you miss 1 payment can they straight away put a default on your file?

    Cairney you're right, they do have to send a notice of default. You should write to them requesting this.

    Another IDIOT! that cant READ! , :-I did not sign any Contract
    I never said i decided NOT to make the payment.
    :-I didnt assume any laws, and i never said anything about paying when it suits me and im definately not demanding anything.
    I have genuine reasons for missing my payments which are to personal to go into.
    Anyways CLIVE im Right! your Wrong! tis there for all to see so lets all laugh at you:rotfl:
  • thanks sol00 i have already sent them a recorded delivery letter requesting as to why this default was placed on my file without my knowledge
