Benefits of employment during notice period

Hi all

Well husband has been made redundant
:confused:
I have a few questions please


Husband has
1) Car allowance monthly instead of comapny car
2) Private health cover

He is now on gardening leave until end of month then on 1 months notice

When do the above benefits stop ? is it at the end of the notice period ? ie.. end April


Can you claim jobseekers whilst on gardening leave
Are the company allowed to ask you to carry out any work whilst on gardening leave

    Sorry to hear this, just been through the same myself.

    Dh should retain all benefits during Gardening leave.
    Jobseekers can not be claimed untill his leave date.
    If it is in his contract that he can be asked to work, during Gardening leave then yes, if not not usually.

    What is his leave date
    The end of his two week gardening leave (March 31st)
    The start of his notice month (April 1st)
    The end of his notice month (April 30th)

    He wont get paid benefits untill he has stopped being paid by this employer, so if he is is being paid while on gardening leave when this stops, so if he was on gardening leave untill the 31st the claim would start the next day, there are exceptions if he is being paid PILION tax free as a lump sum with his redundancy payment, he could be paid earlier, the best thing to do is take all the paper work down with him to his appointment at the JC and they will be able to tell him, the exact date he is eligable to claim from.
    I would ring up and get the ball rolling, as they dont pay for the first few days of the claim anyway.
    Therotically is should be at the end of his notice period, as he has income untill then, however it could also be later if he has holiday pay owing.

    You are not "available to work" as, until the final date of employment, you are under a contract of employment.

    Garden leave means that the employer is simply waiving the requirement for you to be in work.

    So we did online
    We have a face to face meeting for next Tuesday so all will be revealed I guess

    Maybe they can put end of months date on it & process it then ?
    Or more likely we will have to do it all over again from scratch

    Yep, but go careful you are not claiming for something which you are not entitled to.
