Told Company in admin (it's not) no notice, no P45, no payslips, no money

Please help. (sorry this is a little long winded)

On 2nd March my husband was told by his line manager that the company had gone into aministration and that he no longer had a job and to go home. He was told that he would receive the previous weeks wage as normal on the thursday (as you might guess this didn't happen), but other monies owed would have to come through the administrators.

Since then we have found out that the company that he worked for has NOT gone into administration, it is the much larger company that it used to be part of that has. We have been told by the administrator that the company that my husband worked for is not covered by the administration and is in fact still trading (in a different area). Please note this is not a small local company.

He has done no work since 2nd March, had no formal notice of termination received no payslips or P45 for the hours worked, not had any of the monies owed or any correspondence from the company.

On 2nd March he was owed 2 weeks wages, 1 weeks notice and holiday owed. We have been told that given the circumstances strictly speaking he is still employed and as such still incurring money owed, so we can claim no help, benefits etc.
The company will not talk to anyone about this.

Please any ideas on a way forward, surely a company can not just lie, tell you to 'get lost' and then just leave it!!!!! Obviously we really need the money but we also need closure on the matter so we can get ourselves sorted out.

Any help would be much appreciated.

    I would be inclined personally to turn up at work as normal - and say "I'm here because a mistake has obviously been made. I'm clearly still working here - as I've not had any redundancy letter or anything and the DWP has said I'm obviously still working for this firm because of this."

    I suspect he'd darn soon get given that letter, etc, in order to get him off the premises:D

    (there's always the fallback position - if that failed - of doing exactly the same again - with a Press photographer in tow;) :D ).

    If the above does not work (and I'm not sure I would go into work if I still hadn't been paid for work done before), his next step is to go down the ET route. He should ring the ACAS helpline for assistance.

    Yes, ACAS are useful as are Citizens Advice Bureau as a first stop point. Better to act sooner than later too. Best of luck.

    errr....I didnt suggest he should actually DO any work.....just physically BE there....;) :D

    Sorry to hear this, but hope its resolved soon.

    I take it your hubby was not in the works union (if there was one)?

    Its not a very nice situation to be in, I know that due to experience with what happened to my husband and other workers in DEC 2007, in fact just days before Christmas, he worked at a steelworks for many years and I remember it was on a Friday, the workers were told to get out as soon as they got there, so thrown straight onto the scrap heap, it went into administration, no redundancy pay, wages nothing......

    However, I hope its not the case here for your hubby and I agree with the other posters here, is to get some advice on this as well.

  • Hi,

    Thanks all for your suggestions, he would love to get up their noses by just turning up to work but unfortunately the depot in our neck of the woods has completely closed and the only other place we know of is an office you have to be 'buzzed into' so unfortunately that's that out of the window.

    We have got the names and addresses of the company directors who will sortly be receiving letters, else I guess it's the court route.

    I didn't know of ACAS but have had a good nosey on the website and he will be calling them (and paying a visit to the CAB) so many thanks for the 'heads up'.

    Thanks again for all the suggestions and any more would be much appreciated. :D
