I bought a new pair of trousers last week.
Tried them on in the shop, fit perfectly, loved them so much wore them to work the next day.
After 2 hours they had stretched so much (linen) they were ridiculous looking and unwearable, comments from co-workers etc, I had to change out of them by lunch time.
Took them back to the shop who just said, "they've been worn, we can't refund them"
I tried to explain that wearing them was what showed up the problem and I did try them on for fit in the shop before purchase etc, don't expect trousers to stretch by 2 inches on the first wear etc.
Nothing.
I was v cross, kept my temper and asked for details of who to complain to.
Any tips on the letter I should write and chances of a refund.
They are 100% not wearable, even with a belt etc.
I've read the consumer rights article, are they not 'as described' because the sizing has changed (I would say 1-2 clothes sizes bigger after 2 hours wear) or not 'fit for purpose' because trousers are made to be worn and shouldn't show ill'effects from being worn.
Thankyou

Oh well,
don't know if it is a good or a bad sign to get no replies.
Phoned customer sevice, they are paying for me to sent them in to be checked.
I think i will enclose a letter stating the difference in measurements of the fabric now and when i bought them (ie now and my measurements) and how they differ from the size guide on the website. I will use fit for purpose I think.
Thanks for everyone who had a read.

stick with fit for purpose.
have you washed them (wondering if they will go back to the original size)?Remember the time he ate my goldfish? And you lied and said I never had goldfish. Then why did I have the bowl Bart? Why did I have the bowl?0 -
Your on a sticky wicket
It will be hard to prove
Go into shop take a tape measure
measure an identical pair in the affected areas
This will give you the true amount they have given
If the shop refuse to help & it is a chain dircet it to head office they may be aware if it has been a chain wide problem
If it's an independant I think you will struggle"Very funny, Scotty. Now beam down my clothes."
All truth goes through three stages. First, it is ridiculed. Then, it is violently opposed. Finally, it is accepted as self-evident.0 -
Thanks guys, it's Laura Ashley and the no. i called was a central one so as good as head office I think.
I haven't washed them but if I get nowhere with the refund I will try a really hot wash or look into getting them altered i think.
Thanks again for the thoughts.0 -
They should have refunded in the shop due to being faulty, they were going by the rules for unwanted clothes.0
