Part of the Furniture Combo Breaker
Hi Silent Night - you have 16 days from the date halfway down on the right hand side of the N55 to get a completed N56 back to court (it says 8 but its really 16!)

Complete the income part for the whole household (your wages, Oh wages, tax credits, child benefit if applicable) but the expenses part should only be what you pay - if you split everything equally then only put half the expenses there - it may help for you to attach a complete SOA for the whole household as well if you think it will be clearer.

The expenses that are allowed will vary from court to court. Technically only the bare minimum is allowed (an allowance for you, OH and any children,mortgage/rent, council tax, water and any court orders or arrears on priority bills as well as any maintainence. Most courts though allow a small amount for telephone, childcare, tv licence and more rarely car running costs.

Make your offer of payment in the box at the bottom and complete the last part if you want the order suspended (pay yourself) rather than made full (direct from your wages) as long as the form is returned in time you wont be summoned to court.

As an aside the Attachment should have been issued in your home court - ie the one nearest to where you live.

    Hope that helps xx

  • Hi Penguin,
Thanks and glad you could understand my post,
thats just what I wanted to know, thanks.
yes it does say 8 days to get it back to court after service.
Yes it is at my local cc but that is still a long way away, especially when you don't drive.
    Many thanks,
I pay all my wages out on the rent any way so I will just put that and show that hubby pays everything else.
    Thanks again penguin
  • Well, anyway. Just wondered why you kept posting in different colours.

It highlights the main question and I like pretty colours, I am nothing like a DCA.
No nothing is missing i have not had a letter, Phone call, nothing, they want there money now obviously, exactly a year after they got the CCJ.

Well, anyway, ignore anything I said lol

I must say i found that the fact you could not understand my post rather strange, perhaps you should refrain from answering if you do not understand what the OP has written. especially as I am a new forum member, I felt like you were calling me a liar at one point.
The way you went and posted my other question from tonight about something unrelated to this was in mind totally unnecessary.

i asked to pay by installments, i got no reply
You should have received a reply, it's at THAT stage you apply for a redetermination hearing, which is then transfered to your local county court for a hearing.

Anyway, it looks like you're happy with the advice offered above.
