Buildings and contents insurance and convictions

A friend of my has a new partner of about a year and she admitted to me the other day that he has a criminal conviction something to do with accessory to arson I believe. He is nearly 45 years old and has never admitted it to anyone not even his employers. This happened when he was about 20 years old. He never served time apart from remand and stayed inside for about a month. It was 18 months suspended for two years.
She has put him on the mortgage and he of course is named on the building and contents insurance but she never told them about it.
I said I was not sure but I would have thought that it should at least be mentioned and might not effect the preimums but better to be safe than sorry. As it was a spent conviction and according to her he has never even had a parking ticket since.
As I said to her what happens if you have a fire and they think it is arson and they look in to your pasts and find that out. They could lose everything and I mean everything.
I now feel bad as she said that she has not slept since I said that as she is scared.
I also told her that she might find that if she admits it now that her own insurance company might drop her straight away.
I am right or have I made her worry for no reason at all.

I had a customer who queried about a conviction from 1975 - the insurers said it was fine because time had been spent.
I suppose the only way to find out is to ask.0 -

Tell your friend not to worry. Even better, show her this web page about the Rehabilitation of Offenders Act.
Hope this helps.

BC,
Thanks for that. I think what concerned her the most was it was to do with arson and if they had a fire and found out about the conviction that they might say they where not covered for insurance and they would loose everything that they both have worked so hard for.
I will pass it on to her.
Thanks again.

looked at somrthing similiar ( but not arson / more recent) recently for someone - my reply was
I have checked with one of my main providers - asks for details of any convictions rather than "spent" ones, which is potentially misleading as I believe you don't normally need to declare spent ones, but by not doing so it could be deemed as giving fraudulent information.
They will not insure until 2 yrs after the conviction is spent ... my understanding that such a conviction takes 5 yrs before it is spent but not sure
Take a look at http://www.yourrights.org.uk/faqs/criminal-records/insurance-applications.shtml this may give some options

Colin
