If your on benefit, you won't have to pay, you can apply for exemption using form EX160A.ollie2008uk wrote: »I'm going to be waiting ages to save to go BR!
Take a look hereClick here for Martins (MSE) advice on who to contact with Debt Issues - YOU HAVE NO REASON TO USE A FEE PAYING DEBT MANAGEMENT COMPANY- THEY CANNOT DO ANYMORE FOR YOU THAN THOSE LISTED IN MY LINK ABOVE.
All information given by myself is offered informally and without prejudice - if in doubt seek help from a qualified and insured professional0 -
In your first post, you said that you and your partner own a flat.
Ie. you are paying a mortgage or have paid off a mortgage.
If that is the case you would need to find out what would happen to the flat is you filled for bankruptcy.0 -

From reading this site and from what i've heard elsewhere as my flat is in negative equity it should be safe. At the end of the day if they took my home i'd have to find somewhere else to live. As my mortgage is actually lower than rental prices I assume I will be allowed to live in it.0 -
Okay, Ollie. This next piece of advice/info is vitally important not just for Capquest but any other DCA/creditor you may get it from in future. If they ask you to provide proof in the form of bank statements, wage slips, benefits letters, anything at all like that do not send them. They are not entitled to see it beyond an I/E form. It's what CAB does, it's what CCCS does so if they don't need to them as proof of your income neither does any creditor. I mention this because some may try this trick on with you in the future. Either ignore them, just send what you have or simply refuse. Unfortunately, I lost the letter I had in that direction I cobbled together using various things from Data Protection issues, other legal things to basically tell that creditor to get stuffed when they kept asking. But I did get most of it off another forum.
Just mentioning that above in case they might ask you. Only a judge, with a court can ask you to supply those documents.Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.

Thanks for that. As it happens when I called them the 1st things she wanted to know was my employers address etc! I refused to give it to her as I did not see the need for it!0 -
Hi Ollie
While you are here, why not post your SOA (Statement of Affairs). At the very least we might be able to help you to save money faster so you can file for bankruptcy quicker.
I would agree with you about the flat but most of us on this forum are not experts, so if you decide to go for bankruptcy, get some legal advice first. It is always better to be safe then sorry.0 -

Good. They don't even know the law on that, either so just repeat what's in front of them.Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Hi. I don't know how far along your debts are, eg what stage. But, for now, that stage is probably a long way off. And may not even happen.Any help, opinions, views I may hold those are my own.
