    The shop doesn't have any liability to you as you were not the purchaser. Equally, as there is nothing wrong with the goods they don't have to do anything at all and any offer by them to issue a credit note is purely a goodwill gesture.

    Shops have to protect themselves from unscrupulous people who steal things and then try to obtain money back from them. Whilst this may not be the case here they have to be alert to it.

    sell it on ebay if you think you can get more that the £5.99 refund on offer.
  • Like originally stated i only wanted advice because i have never encountered this before because as someone else has mentioned other shops dont have a problem with it thats why i was unsure.
    But to the other posters who want to misread what i posted and make presumptions then you are not helping with my query.
    Obviously i didnt want to post up the ins and outs and if i could get the receipt then i would.
    I am quite aware what receipts are for.
    When someone is saying to you that "you could of' stolen" instead of more appropriately saying "other's steal" then yes i find it insulting.
    I will be asking the person to go in with their debit card, i merely asked if it was true ie. can this be done.
    I will "get over it and move on" now that other members have been helpful enough to answer my original post.

    Think I would be cross if someone said I could have stolen it too,I think that is your issue here,not the other issue.

    M & S used to have one of the most relaxed returns policies in the High Street. Some years back they realised they were getting ripped off and had to tighten their approach to returns. People were just taking advantage of them in so many ways.

    The M&S policy also created a total nightmare for independant retailers

    People took it as being law instead of an individual policy
    It has caused stand up rows in shops all over the country just ask any shop assistant/owner/manager

    Some people were making over 100k a year by stealing clothes then taking them back for refunds.
