Dear .......
we are writing to inform you of our intention to commence legal proceedings against you in seven days.

On (date) your vechile a was parked illegally contravening the terms and conditions of car park regulations situated at a store on a road, in a town (these parts were changed by me) therefore you were issued with a civil notice parking charge.

However this debt still remains unpaid. If payment has not been received within seven days we will have no alternative but to commence legal proceedings against you which will incur additional interest, court costs and may affect your personal credit score when applying for finance in the future.



My mum received this letter today, Im guessing we shold just ignore it, but she is really worried.

They also stated in it that the "fine" had been raised to £120, this is the first letter that has been received from them. Is it worth sending a cease and desist kind of letter or just ignore it altogether?

    Is it worth sending a cease and desist kind of letter
    Any correspondence will merely convince them they have hooked a sucker and they will send ever more threatening letters

    Legally, only Local Authorities can issue & pursue PCNs (and then only if the vehicle is parked on either a public road or on Local Authority land such as council car parks). Private land owners (and this includes hospitals and railway station car parks) can clamp your vehicle, but if they pursue a PCN issued for parking on private land, and you don't pay, the only option is to try to prosecute you for 'Trespass'. For this, they would have to prove you had no legal right to be on the land, in the case of a car park, this would be hard to prove as it is open to use by any member of the public.
