my sons girlfriend bought a car off ebay a few months ago, they had the car hpi checked and it came up clear( don't know which one they used though), to cut a long story short she went to part ex the car and was told it had outstanding finance on it, she has been through to the seller and keeps being ignored, so the finance company was contacted, the person who sold the car is still paying the finance but she wants the car removing from the finance register so she can sell it.
She has spoken to the finance company numerous times and her grandfather went down, they said they would sort it but still haven't. I know the car has fraudulently been sold because of the outstanding finance (it wasn't mentioned on the ebay ad either) I also know because she paid a fair price for the car the finance company cannot chase her for payment if he defaults (this is under the consumer act as a private buyer)
What I want to know is what action can now be taken with the finance company to get the car removed from the finance register as now they have been informed the car has fraudulently been sold they have some sort of responsibility to rectify the problem.
Hope you can help as paying them a visit next week!
