Can I Do A Chargeback By Debit Card?

I ordered tickets for a local gig but the venue has now closed. I bought the tickets by clicking on the bands website and going through their 'buy tickets' link which took me to ticket-web. Now ticket-web say they are not responsible for venues. gigs, problems, changes etc (its in their terms), the venue are uncontactable, the venue owner is not contactable and the band say they have nothing to do with tickets and everything was arranged by the venue. Now since I bought the tickets from the bands website and they had the link on 'buy tickets' to this ticket-web I would have thought I bought my tickets from the band. Either way I have tickets but no gig and I paid by debit card - can I do a chargeback or who do I 'go after' to get a refund?

    if venue closed, all events ould be cancelled, money should be refunded by the promoter?

    get onto whoever the money went to, from your bank a/c- may alos be worth contacting your bank to dispute the charge as 'goods not recevied'..

    No idea who the promoter is - went to bands website and paid money to Ticket-Web via their 'buy ticket' link - saw nothing about a promoter and it looks like the band organise their own gigs from what I can tell (small-ish band not national or chart music etc).

    Hopefully the band will be able to re-arrange a different gig or venue but will contact my bank to say items not received and see what they say if the band cant do a similar gig elsewhere or if I needed to re-buy tickets for new gig - thanks

    ADDED - on bank statement it shows payment went to ticket-web and in their terms it says:
    TicketWeb is not responsible for the products, services, actions or failure to act of any venue, performer, promoter or other third party in connection with or referenced on the Site.

    They may not be responsible for the products, services, actions or failure to act (i.e., the band was awful, the staff incompetent and the guitarist smashed up his equipment and the splinter got in my eye!) but surely they're reponsible for taking money off you and refunding it whenever an act cancels.

    If not then I know where I should be setting up my next business venture.

    Guaranteed money by advertising a gig then cancelling it? Result.

    The OP used the term "chargeback" - I'm afraid this is a most misused and misunderstood word.

    Chargeback applies to a Credit Card transction which fails. Say you order something from Bloggs and Co and it never arrives. If you then request your card issuer to do a chargeback, he recovers your money from Bloggs and Co via the credit card organisation and the banks involved.
    If Bloggs and Co have gone bust, or done a runner, if the sale was over £100 you can use Sect 75 of the CCA to recover your money.

    None of this applies to a purchase made on a debit card, which is in effect a cash transaction. Some Card issuing organisations/banks/Building Societies will try and recover funds as a goodwill gesture but there is no legal requirement for them to do this.

    Moral: If you can, always pay by Credit Card.

    best get on to trading standards, too - could be a scam. (why would they sell tix for a venue that is closing down?).

    and i am sure the band would want payment beore any gig, so they MIST have some sway with the agency, who in turn takes a commission from sales?

    YES :) It was a visa debit so thats good news

    Still waiting on band coming back to me hopefully they will transfer to a new venue as seen them before and would rather see them again than get a refund.

    Is not a scam as the venue is a big well-known one locally which closed it doors very suddenly which was even a surprise to those who owned it. When I contacted the band a few days later they knew nothing of this and had their hotel/travel etc booked so are looking into it.

    Again thanks for all the help will let you know how it go's - hopefully a new venue/gig :)

    given that the original poster has said that it isn't a name band involved, then I think we can be pretty certain that the tickets were'nt over £100 each, so legally paying by credit card wouldn't have helped in this case.
